A TCEQ Notice of Intent (NOI) is an application requesting permit coverage under the Construction General Permit (CGP) TXR150000. The CGP allows contractors and developers to discharge stormwater into state waterways, provided they comply with the terms of the permit. The first CGP requirement for contractors and developers is to develop a Stormwater Pollution Prevention Plan (SWPPP). The second requirement is to submit the TCEQ notice to obtain coverage. There are two paths for obtaining coverage under the CGP, depending on the size of the site.

  1. Sites disturbing under five acres can receive automatic authorization by completing a TCEQ Small Construction Site Notice and submitting the notice to the local regulatory agency two days prior to starting construction.
  2. Sites disturbing over five acres or are part of a common plan of development disturbing five or more acres must submit a Notice of Intent through the State of Texas Environmental Electronic Reporting System (STEERS), pay the $225 application fee, and submit your NOI to the local regulatory agency two days prior to starting construction.
